TRADEMARK

I. REGISTRATION PROCEDURE
International Classification for Products and Services under the Nice Agreement (8th) is applied in Laos. Each trademark application can only be filed for 01 trademark and 1 class of products/services. An applicant can claim priority right to a mark under the Paris Convention.
1. Minimum application documents
To apply for a Trademark registration in Laos, the Applicant needs to provide the following information and documents:
  • Original notarized power of attorney, translated into English. Copies can be used when filing the application, but the original must be supplemented within 01 month from the date of application. The POA is valid for 5 years from the date of signing;
  • Full name and address of the Applicant;
  • Sample of trademark (18 samples) no larger than 100mm x 100mm and no less than 50mm x 50mm;
  • English translation and translation of the meaning of the Mark if the mark is not in English;
  • List of registered products/services;
  • Information applying for priority right (if any);
  • Fees and charges
2. Registration period, protection period
  • Certificate of Trademark registration in Laos will be issued within 16-18 months from the filing date;
  • The period of trademark protection in Laos is 10 years from the filing date (or from the priority date, if any). Registered trademarks can be renewed every 10 years;
  • The registered trademark owner is obliged to use the Trademark in Laos. If a trademark has been registered without use, it may be invalidated at the request of a third party.
  • “First to File” principle is applied in Laos
3. Declaration of trademark use in Laos
In order to avoid the cancellation of a registered trademark on the basis of non-use, the trademark owner must submit a Declaration of Use or Non-use within 01 year after 05 years from the date of registration of the mark. Documentation includes:
  • Declaration of use or non-use of trademark in Laos;
  • Original Certificate of Trademark Registration.

II. PROCEDURES FOR RENEWAL
1. Required documents
  • Original notarized Power of Attorney;
  • Copy of Trademark Registration Certificate;
  • Fees and charges
2. Time duration
  • Time to complete procedures for trademark renewal in Laos is 5-7 months from the date of filing.
III. RECORD THE CHANGE OF NAME/ADDRESS
1. Required documents
  • Original notarized Power of Attorney;
  • Notarized original Statement of Change of Name/Address or other legal documents showing change of name/address;
  • Copy of Trademark Registration Certificate;
  • Fees and Charges.
2. Time duration
  • Time to complete the procedure to record the change of name/address of the trademark registration in Laos is 5-7 months from the date of filing.
IV. REGISTRATION OF ASSIGNMENT CONTRACT
 1. Required documents
  • Original notarized Power of Attorney;
  • Original notarized/confirmed assignment contract;
  • Copy of Trademark Registration Certificate;
2. Time duration
  • Time to complete the procedure for registration of trademark assignment contract in Laos is 6-9 months from the filing date.
V. REGISTRATION OF LICENSE CONTRACT
1. Required documents
  • Original notarized Power of Attorney;
  • Original notarized/confirmed license contract;
  • Copy of Trademark Registration Certificate;
2. Time duration
  • Time to complete the procedure for registration of trademark license contract in Laos is 6-9 months from the filing date.
