TRADEMARK

I. REGISTRATION PROCEDURE
International Classification for Products and Services under the Nice Agreement (8th) is applied in Cambodia. Each trademark application can only be filed for 01 trademark and 1 class of products/services. An applicant can claim priority right to a mark under the Paris Convention.

1. Minimum application documents
To apply for a Trademark registration in Cambodia, the Applicant needs to provide the following information and documents:
  • Full name and address of the Applicant;
  • Sample of trademark (18 samples) no larger than 100mm x 100mm and no less than 50mm x 50mm;
  • English translation and translation of the meaning of the Mark if the mark is not in English;
  • List of registered products/services;
  • Information applying for priority right (if any);
  • Notarized power of attorney;
  • Fees and charges
2. Registration period, protection period
  • According to regulations, after a valid application is filed, the trademark application will be published online instead of the traditional paper publication;
  • Certificate of Trademark registration in Cambodia will be issued within 16-18 months from the filing date;
  • The period of trademark protection in Cambodia is 10 years from the filing date (or from the priority date, if any). Registered trademarks can be renewed every 10 years;
  • The registered trademark owner is obliged to use the Trademark in Cambodia. If a trademark has been registered without use, it may be invalidated at the request of a third party.
3. Declaration of trademark use in Cambodia
In order to avoid the cancellation of a registered trademark on the basis of non-use, the trademark owner must submit a Declaration of Use or Non-use within 01 year after 05 years from the date of registration of the mark. Documentation includes:
  • Declaration of use or non-use of trademark in Cambodia;
  • Original Certificate of Trademark Registration.

II. PROCEDURES FOR RENEWAL
1. Required documents
  • Original notarized Power of Attorney;
  • Copy of Trademark Registration Certificate;
  • Fees and charges
2. Time duration
  • Time to complete procedures for trademark renewal in Cambodia is 5-7 months from the date of filing.

III. RECORD THE CHANGE OF NAME/ADDRESS
1. Required documents
  • Original notarized Power of Attorney;
  • Notarized original Statement of Change of Name/Address or other legal documents showing change of name/address;
  • Copy of Trademark Registration Certificate;
  • Fees and Charges.
2. Time duration
  • Time to complete the procedure to record the change of name/address of the trademark registration in Cambodia is 5-7 months from the date of filing.
IV. REGISTRATION OF ASSIGNMENT CONTRACT
 1. Required documents
  • Original notarized Power of Attorney;
  • Original notarized/confirmed assignment contract;
  • Copy of Trademark Registration Certificate;
2. Time duration
  • Time to complete the procedure for registration of trademark assignment contract in Cambodia is 6-9 months from the filing date.

V. REGISTRATION OF LICENSE CONTRACT
1. Required documents
  • Original notarized Power of Attorney;
  • Original notarized/confirmed license contract;
  • Copy of Trademark Registration Certificate;
2. Time duration
  • Time to complete the procedure for registration of trademark license contract in Cambodia is 6-9 months from the filing date.
